The owners are litrally minting money with rentals. Last time my previous owner deducted almost 25% after I stayed in the house for 3+yrs. I really dont understand why they have to take this much amount and then deduct in the end...

I have read all the posts in this forum.

Even when i was in USA, i have paid only 1 month rent as Deposit. But in USA, they have something like CREDIT HISTORY which is checked prior to giving the house. The tenant is liable in a very big way.The rent itself was 1/3 my salary.

The reasons for a 10 month advance could be for a SECURITY. Towards any damages made to the house.
Offlate in Bangalore the incidents of WRONG doings are on the rise. When Police locks up the house for investigation, the owner has no where to go.

IF YOU DONT want to pay 10 months rent, negotiate with the owner, say will pay 80% now and 20% after 2 months OR You may have to pay less advance and MORE RENT if that is okay with you.

I am staying in a house paying 10 months advance.

The USA story is so true..

There you have to sign lease for 7months or 1 year. There is no 8 months option or other options.
I had such tough time coming back at 5 months to india. They asked me to pay about 3500$ as lease breakage.
I dint even have that kind of money.
Also they said they will check the house for cleaning and damages and charged 450$.
LEASE BREKAGE is such a suicidal thing.

I really dont see the problem in paying 10 months advance and staying for as many months as I need.
As life is unpredictable. I may need to change my house at any time. Atleast in Bangalore we have that opiton.

Seriously guys if you had to give your house to some stranger wouldnt you want a Security Deposit.

For people who quote other Developed countries as examples, probably do not know the truth about living there.

Guys here is a tip for you...

Instead of worrying about the Security Deposit ... check your Rental Agreement properly.

Instead of calling owners and scolding them for asking 10 months advance, TALK to him to access his trust.

The Agreement should be favorable to both parties.

15 Simple points by RS-

1. The Owner has offered the monthly rent of <rent> (Rupees <in words>) in respect of the schedule premises. The Tenant has agreed to pay the monthly rent to the Owner on or before 5th of next month regularly.
2. This rent agreement is only for a period of 11 months commencing from <date>.
3. The Tenant has agreed to a total sum of <advance>/- (Rupees <in words>) towards Security Deposit amount, hence under and henceforth termed as Security Deposit amount. The Tenant has already paid a sum of Rs 10000 out of the Security Deposit on <date> as token advance And <amount> on <date> by way of online transaction in favor of Owner <Name> , with <account number> of <Bank>, <Branch>.
4. The Owner has agreed to repay the said Security Deposit to the Tenant, 50% upon vacating (or within 5 days of notice, whichever is later) and remaining within 15 days of vacating the Schedule premises after adjusting the move out charges, dues or damage charges to schedule property or interiors, if any, and the said amount will not carry any interest.
5. The Tenant has further agreed that he will enhance the monthly rent at rate of 5% (five) after every year.
6. The Tenant hereby agrees that the schedule premises inclusive of interiors, facilities and fixtures are safe, secure and worthy of renting.
7. The Tenant hereby agrees that he will pay the electricity (Electricity Consumer Number Sub Division R R Number ) and water charges in respect of the schedule premises as per the Electric, Water bill vide separate meter to the concerned authority on time, billed till the time of vacation.
8. The Tenant further agreed to share maintenance charges of the apartment as decided by the apartment committee, on time, till the time of vacation.
9. The Tenant shall allow the Owner or his representatives to inspect the scheduled property at intervals.
10. NOTICE PERIOD -60 (Sixty) days. If in the event the Tenant wants to vacate the schedule premises he would be responsible for the notice period. In case the tenant wishes to move out at the end of this agreement, he must inform prior to the end of this agreement, which shall go into the notice period. During notice period, the tenant shall cooperate in showing the house to prospective tenants. Similarly if in the event the Owner wants the Tenant to vacate the schedule premises he should intimate the Tenant according to notice period.
11. The Tenant hereby agrees that he is of clear conduct and title at the time of renting the schedule premises and shall remain so.
12. The Tenant hereby agrees that they will keep the schedule premises clean and will not damage the nature of the schedule premises or surrounding. And will not sub-let and will not use for unethical or illegal purposes and will be of no nuisance to the other residents of the apartment or locality.
13. If the Tenant does not pay the rent on time or never for continuously 2 months or more, or commits breach of any of the terms herein, the Owner shall have the right to evict the Tenant without any notice.
14. At the time of move out, the Tenant shall bear MOVE OUT CHARGES amounting to 1(one) month current rental charge which shall be debited from the security deposit placed with the Owner. This charge includes Reassigning Cost, painting, and/or cleaning of the schedule premises (based on the maintenance of the house), but minus damage and restoration charges.
15. All disputes are subject to Bangalore Jurisdiction.

looting the money...they do not even return the money once you vacate the house but only after new tenant comes in. i have the following example: i got shocked when i was doing silly calculation few days back, my house owner holds around 1 cr as deposit from all his tenants (appx. 50+ flats) . he will not pay back until new tenant comes even if somebody vacates. he increased 35% rent for the year 2012 for the flat where i'm staying even for others the same. he is constructing 3 new illegal flats on the top of this so called small apartment with out proper parking, vetilation and fully violation of rules and regulations. he promise car parking for everyone but in reality we do not even get bike parking if you reach home late. he will not even respect tenants property...best example is that... they have removed and disconnected all DTH instruments from the roof without intimation, they disconnected the cable like airtel, bsnl internet etc. This house is located in JP nagar 5 phase close to kalyani magnum.

I am a landlord AND an <a href="http://gaavtuvoxcz.com">inrsnauce</a> sales rep so I have experience from both sides of the situation. You couldn't get renters <a href="http://gaavtuvoxcz.com">inrsnauce</a> because that is the coverage a tenant gets to cover their belongings, it don't cover the home. Now you don't need full home owners <a href="http://gaavtuvoxcz.com">inrsnauce</a>. It is a waste of money on your part. If your personal home burns down you need coverage on the home and your contents inside. If your rental home burns down, what do you need covered? Just the home, not the contents. As a landlord you are NOT responsible for the tenants contents. You need to reduce your home owners policy to only structure coverage. It will cost much less and is best when it comes to responsibility, if something should happen. You should contact a company like State Farm(they pay claims really well), Farm Bureau, American Family(although I personally don't care for them and how they pay claims). They are going to have more knowledge on what you are looking for.

Can some one help me please?

I have taken up a rented house in Bangalore about 7 months ago and planning vacate in other 2 months so the total period of my stay would be 9 months. I have got into 11 months agreement but I cannot continue staying due to some family related priorities. I am moving back to my In- laws place which is out of Karnataka. I have already let the landlord know about it but here if husband says something, the wife would sing a different song. From what I have observed, the wife is really money minded. Both of them are Govt. employees and have let many house for rent.

When I went to give a notice, the wife started stating that I have to be here for 11 months or else they will deduct the money from my deposit (this is not mentioned in the agreement) . I have paid nearly 8 months rent as deposit! Right now I am not in a condition to lose any money as I am no longer working. I am sure that they will not happily refund my money coz I have seen that the lady over charging me for water usage and she made me pay the entire month electricity bill which was used by the previous tenant. This makes me feel that she is very greedy for even 50 or 100 Rs. I have not told them anything till date but I guess I will be furious if they play a foul game while returning my deposit. I am anticipating this only because I saw what had happened when my neighbour left the house (within 2 months ) coz the owners asked them to vacate... They ended up fighting and these ppl deducted the painting charge and never painted the house before letting the next tenants in...

Can some one please tell me how I can tackle this situation and get my entire deposit back without any fights or hard feelings?

BTW- thinking about approaching a police wouldn't be a good idea as the owner himself is in police dept... :cry: Wife is taking advantage of this to threaten people.
